Rented scooter, quad or ATV damaged in Croatia: deposit, damage list and what a file needs

A scooter for the island, a quad for a beach track, an ATV on an organised tour โ€” the rental takes ten minutes and the paperwork is one page. When something happens, that page decides far more than anyone expected at the counter.

Why this is not the same as a hire car

A small vehicle rental differs from a car rental in three ways, and all three appear only after damage.

The deposit does the work of an insurance policy. Cover with a reduced excess is often not offered at all, and the amount blocked on the card is what settles the case in practice.

The handover record is thin. A car rental has a diagram with marks on it. A scooter counter usually has a line of text, and existing scuffs on plastics, mirrors, levers and the underside of the fairing rarely reach the paper.

Use limits are wider than they look. Unsurfaced tracks, beaches, an island crossing by ferry and organised off-road tours may sit outside what the contract allows. That is a question about the contract, worth reading before signing.

What to photograph, and when

Two short sequences decide almost every later dispute.

The two minutes at the counter are the cheapest evidence in the case. Marks that were there beforehand are almost impossible to prove afterwards, and they are the most common subject of dispute in this category.

Do not have anything repaired before it is recorded. A quick replacement of a cracked panel removes the only thing that shows how the damage arose.

What an assessment can establish afterwards

Damage to a scooter or a quad reads differently from damage to a car, and that works in favour of a careful file.

Plastics show direction. Cracks radiate from the point of contact, and transferred material, scrape depth and the height of the mark on the body describe what the vehicle met. A photograph taken before the parts are removed carries most of that information.

The frame matters more than the paint. On a two-wheeler the fork, the steering head and the swingarm decide whether the machine is repairable at all, and on a quad the same applies to the A-arms and the steering.

Old marks can be separated from new ones. Edges, dirt in the scratch and oxidation of exposed metal place a mark in time within limits stated in the report.

What is outside our role. We do not decide whether the deposit was rightly retained, we do not interpret the rental contract and we do not assess cover under any policy. Those belong to the parties, to the insurer and, in a dispute, to a recommended lawyer.

The rental company kept the whole deposit for a scratched fairing. Can that be checked?
The technical side can. A report describes which damage is present, how it arose and what restoring it involves, and it separates marks that predate the rental where the evidence allows. Whether the amount retained matches the contract is a legal question for the parties and, if it stays disputed, for a recommended lawyer.
The quad rolled on an organised off-road tour. What matters most in the first hour?
The position of the vehicle before it is moved, the surface and the obstacle in the same frame, and the details of the operator and guide. Photograph the machine from both sides and underneath, note the time, and keep the briefing sheet. That material cannot be recreated the next day.
The scooter already had marks when I collected it. How do I show that now?
Through anything dated from the handover: photographs, a video, the contract with its note, a message sent that day. Without such material an assessment can still separate fresh damage from older marks by their edges and by the state of exposed metal, though the conclusion is narrower.
